These General Terms and Conditions of Sale are governed by the Consumer Code (Legislative Decree no. 206/2005), Section II, Distance Contracts (Articles 50–67), as amended by Directive 2011/83/EU and implemented by Legislative Decree of December 3, 2013, as well as by the laws on electronic commerce (Legislative Decree no. 70/2003). They apply to the online sale of products as identified and listed on the Website. The Customer is invited to print or save these General Terms and Conditions in their preferred manner. In case of changes to the General Terms and Conditions, the version published on the Website at the time of the Customer’s order submission will apply to that order. By submitting the order, the Customer declares to have read, understood, and accepted these Terms and Conditions of Sale.

The following terms and conditions regulate remote purchases of goods offered on the website goccia.shop. By placing an order on the website, the customer accepts the following conditions and declares to have read them.
1) Shipping
Goccia.shop uses the best shipping companies to ensure your order is delivered on time.
Shipping will be processed once payment has been received (except for cash on delivery orders).
Delivery times may vary if the recipient's address is located in a remote area and/or island.
Delivery times are calculated from the day of processing.
Delivery punctuality may also be affected by postal or courier delays, logistical issues, adverse weather conditions, or the courier's inability to reach the recipient due to incomplete or incorrect address information.
We do our best to ensure all orders are delivered within the expected dates, but in rare cases, delays may occur, especially during busy periods such as sales or holidays.
Any delays or missed deliveries caused by the courier are not directly attributable to LDA Fashion srl.
We will do our best to keep you updated regarding your delivery, and you will always be able to track your parcel using the tracking number on the courier’s website.
We do not ship to P.O. boxes but only to physical addresses.
Shipping costs, where applicable, are added to the product price and are displayed at checkout. Available options: Standard Shipping, Express Shipping, In-Store Pickup.

Express delivery is available Monday to Friday.
Orders placed after 12:00 PM will be delivered within 2 business days after processing.
No deliveries are made on weekends or public holidays.
Not available for #GOCCIART products.

At checkout, select InPost as your courier. Wait for our notifications to collect your parcel from one of the InPost Lockers or Points.
You can collect your parcel within 30 days from the notification. After this period, the package will be returned to the sender.

2) Prices
Product prices include VAT and may be changed at any time.
During checkout, before payment, the total cost of the order will be summarized and may be modified or canceled entirely.
3) Liability and Warranty
LDA Fashion srl is not responsible for any direct or indirect damages or losses arising from the sale of the items listed in the catalog, nor for delayed or failed delivery, nor for any other event not directly attributable to the company.
LDA Fashion srl assumes no responsibility for lost items after delivery or for damages resulting from the use of clothing, footwear, or accessories.
The warranty terms applied are those provided by the manufacturer. It is the Customer’s responsibility to verify the quantity and condition of the goods upon delivery.
If the Customer finds that the goods are damaged or do not match the ordered quantities, they must report this to the carrier, sign the delivery note “subject to verification,” and notify LDA Fashion srl within 3 days of receiving the shipment. LDA Fashion srl will then (after verifying that the returned product(s) are intact, in their original packaging, complete with all parts including packaging and accessories) replace the missing or damaged goods in accordance with the purchase order.
4) Payments
Payment for your order can be made using the following methods:
PayPal – Fast and 100% secure. Also available with secure payment in 3 monthly installments.
Credit Card
Satispay
USDC - criptocurrency
Cash on Delivery (Italy only) – Cash payment to the courier; additional cost €5.99; valid only for orders from €20 up to €200; not valid for "In-Store Pickup" and "InPost".
All credit and debit card transactions are charged at the time of purchase.
5) Returns and Refunds
Pursuant to Legislative Decree no. 206/2005, the customer has the right to withdraw within 30 days of receiving the order.
Returns are free of charge in Italy.
The return for a size exchange is free (in Italy) of charge the first time. Any subsequent size exchanges or returns are at the customer’s expense.
Returns from abroad are not free, and size exchanges are not available.
Return shipping costs for customers residing outside Italy are at their own expense.
The returned product must be intact, undamaged, unworn, or unwashed, with the original tag and box (if applicable).

The refund will be issued within 14 days of receiving the returned goods. All additional costs paid (standard or express shipping and cash-on-delivery fees) are excluded from the refund.
Goccia.shop also reserves the right to disable cash-on-delivery payments for users who have repeatedly refused delivery without justification and without having previously contacted customer service.
For purchases made by credit card: refunds can only be processed using the same payment method used for the charge. Refunds cannot be sent to another destination, such as a different card or bank account.
6) Product Availability
Goccia.shop reserves the right to accept or reject orders and, in any case, until stock runs out. In case of non-acceptance of an order (e.g., unavailable item), following an informational email, we will offer a refund or an alternative product choice.
7) B2B purchases
Goccia.shop does not directly target B2B customers but is a website aimed at B2C customers. To place B2B orders and request an invoice, you must first contact customer service at assistenzaclienti@goccia.shop.
8) Image Use
The images on the GOCCIA.SHOP website are the property of LDA Fashion srl. Any unauthorized use without written consent from LDA Fashion srl will be prosecuted according to law.
Please note that some images on this website are generated using artificial intelligence technologies. Photographic models and virtual try-on simulations are to be understood as AI-generated digital representations: the visual rendering of garments on the body is therefore simulated and may differ from the actual appearance of the product.
9) Technical Information
The technical information included in product sheets is based on data provided by the manufacturer.
Goccia.shop therefore reserves the right to modify or update, where appropriate, the technical information of catalog products for descriptive purposes.
As an authorized retailer of all brands featured on the site, goccia.shop guarantees the authenticity of every item.
10) Sensitive Data
Your credit card data is managed by PayPal. LDA Fashion srl and its employees will never have access to this information. If you choose PayPal as your payment method, please read the service conditions on their website carefully.

12) Alternative Dispute Resolution (ADR) / Online Dispute Resolution (ODR)
EU Regulation no. 524/2013 and Legislative Decree no. 130/2015 introduced a system to promote out-of-court settlement of disputes between consumers and traders concerning products or services purchased online. To this end, a European Online Dispute Resolution (ODR) platform has been created, accessible at http://ec.europa.eu/consumers/odr/. Through the ODR platform, consumers can submit a complaint related to an online contract with LDA Fashion srl and initiate the online dispute resolution process. The steps are as follows:

- agreement on the resolution body
- handling of the complaint by the resolution body
- resolution and closure of the complaint
13) Applicable Law, Jurisdiction, and Competent Court for Non-Consumer Users
These Terms and Conditions are subject to Italian law. For all orders placed by subjects not qualified as “consumers,” any dispute relating to the interpretation and/or execution of this contract shall be under the exclusive jurisdiction of the Court of Tivoli.
For consumer customers, the competent court shall be that of the consumer’s place of residence.
